Your core rights in the special-education process — keep this handy for every meeting.

You have the right to

  • Request a special-education evaluation in writing at any time
  • Give — or withhold — consent before the school evaluates or places your child
  • Inspect and review all of your child's education records
  • Participate as an equal member of the IEP team in every meeting
  • Receive Prior Written Notice before the school proposes or refuses a change
  • Disagree with the school's evaluation and request an Independent Educational Evaluation (IEE)
  • Bring anyone you choose to a meeting (advocate, friend, expert)
  • Receive information in your native language
  • Resolve disputes through mediation, a state complaint, or due process

Good habits

  • Put every request in writing (email counts) and keep a copy
  • Take notes at every meeting; follow up with a recap email
  • Keep a single binder/folder with evaluations, IEPs, and letters
  • Track the school's deadlines so nothing slips
