Your core rights in the special-education process — keep this handy for every meeting.
You have the right to
- Request a special-education evaluation in writing at any time
- Give — or withhold — consent before the school evaluates or places your child
- Inspect and review all of your child's education records
- Participate as an equal member of the IEP team in every meeting
- Receive Prior Written Notice before the school proposes or refuses a change
- Disagree with the school's evaluation and request an Independent Educational Evaluation (IEE)
- Bring anyone you choose to a meeting (advocate, friend, expert)
- Receive information in your native language
- Resolve disputes through mediation, a state complaint, or due process
Good habits
- Put every request in writing (email counts) and keep a copy
- Take notes at every meeting; follow up with a recap email
- Keep a single binder/folder with evaluations, IEPs, and letters
- Track the school's deadlines so nothing slips
